SafeRacks Limited Lifetime Warranty

EAGLE INDUSTRIAL GROUP INC. (EIG) (DBA SAFERACKS) Seller warrants to the original purchaser that its products are free from defects in materials & workmanship and will perform in accordance with its published specifications. This warranty does not cover damage resulting from improper handling or shipping of product, or damages by, misuse, abuse, fire, flood, improper installation, acts of God, neglect, corrosion, modification or mishandling. In addition, this warranty does not cover cosmetic damage including scratches, dings, dents or cracks that do not affect the structural or functional capability of the product. Coverage terminates if the original purchaser sells or otherwise transfers ownership of the product.

To report a warranty defect, please contact customer care at support@saferacks.com. Please include your telephone number and invoice number. If, after inspection, we find that the product is defective in materials or workmanship, we shall at no charge to you repair or replace the product at our discretion, and return the product to you. You are responsible for shipping costs but there is no charge for the inspection. This warranty excludes claims for incidental or consequential damages in connection with the warranty problem. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state or country to country. Damages to the product, property or persons resulting from improper use (overloading), installation errors or buyer negligence are not covered by this warranty. Damage is not covered if storage loads are not evenly dispersed or the maximum load capacity exceeds (600 pounds for a 8' x 4' 800lbs for super-duty 8' x 4'), (500 pounds for a 8' x 3' and 6' x 4'), (400 pounds for a 6' x 3' or 8' x 2'), (300 pounds 6' x 2' and 4' x 4') units. If any other parts (not provided by Safe Racks) are used in conjunction with the SafeRacks product the warranty will be void. Outside the 50 United States, this warranty does not apply.

IMPLIED WARRANTIES, INCLUDING TO THE EXTENT APPLICABLE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED TO THE EXTENT LEGALLY PERMISSIBLE. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW ARE LIMITED TO ONE YEAR, OR THE SHORTEST PERIOD ALLOWED BY LAW.
No other warranties are expressed or implied for the storage product. In the absence of an implied warranty period under the rules of law, seven years shall be the term of the implied warranty. Receipt of purchase of product from approved dealer must be presented for warranty to be in effect. EIG makes no other warranties under the terms of the Limited Warranty and the option of repair or replacement is EIG's only obligation. EIG is not responsible for any other special, consequential (including substrate failure) or incidental damages resulting from the purchase or installation of the unit, regardless of cause. Liability for any such losses (including, but not limited to, financial loss, or loss of facilities use) regardless of cause or breach of implied warranty is expressly disclaimed and excluded herein. Upon signing or initiating this form, customer agrees the he/she is requesting this installation solely for the personal use and will not divulge any installation techniques, secrets, or product information to any other person for any reason. Please consult your state's laws regarding warranties. You may have rights in addition to the Limited Warranty. By signing this sheet customer agrees to the warranty and agrees that delivery/installation of product was done to his/her complete satisfaction. All charges are due upon receipt. Any charges not paid in a timely fashion shall be subject to a financing charge of 1.5% per month or the greatest extent permissible under this state's law, whichever is greater. Customer shall reimburse EIG for any charges incurred due to returned payments, such as bank fees. The charges shall be deemed acceptable to Customer and Customer agrees to forego any claim relating to the amount or calculation of charges UNLESS Customer notifies EIG of such dispute as to amount or calculation of charges in a writing postmarked within fifteen (15) days of the date of the original invoice regarding such charges. NO REFUNDS OR EXCHANGES WILL BE GRANTED. Customer agrees to indemnify, hold harmless and defend EIG and it's directors, officers, employees, successors and assigns from and against any and all claims and legal proceedings of any kind for loss, damage or injury (including attorney's fees and costs) brought on against EIG due to fault or cause of the Customer.
